In 2019 and 2020, the UK's regulator for data protection (Information Commissioner’s Office, or ICO), has repeatedly warned the tech & marketing industries to do more to protect users' personal data. One heavily used technology is the use of cookies to collect anonymised or personal data for a variety of uses: A/B testing, analytics, conversion optimization, remarketing & more. About cookies and similar tracking technologies, the ICO advises brands' & publishers' marketers to ""tell people if you set cookies, and clearly explain what the cookies do and why. You must also get the user’s consent. Consent must be actively and clearly given. There is an exception for cookies that are essential to provide an online service at someone’s request (eg to remember what’s in their online basket, or to ensure security in online banking).""
Similar advice is given to Irish companies by the Data Protection Commission (DPC). In August 2019, the DPC started a deep examination of the use of cookies and similar technologies on a selection of websites, and shared its findings in April 2020, describing one of the most widely used cookie consent collection platforms to be “confusing and potentially deceptive."" The report also found that many organizations were aware that they may not be compliant with cookie guidelines, and/or that they had identified improvements that they could make to demonstrate compliance. The DPC gives them a six-month window to get in compliance with the new cookie guidance; after that they will take action to enforce it.
